Why No Fault Divorce Matters

The end of a relationship is rarely straightforward, but the legal process shouldn’t add unnecessary conflict. No Fault Divorce was introduced to help people separate with less stress, less blame, and more clarity.

Instead of having to point fingers or prove fault, you can now simply confirm that the relationship has broken down. This shift makes it easier to focus on what really matters: your wellbeing, your future, and any children involved.

Here’s how No Fault Divorce makes a difference:

Removes the need to blame or prove wrongdoing

Supports a more respectful and cooperative separation

Creates space for clearer decision-making about children and finances

Helps reduce emotional strain and conflict

Makes the process more predictable and easier to manage

Allows both parties to move forward with dignity and less stress

No Fault Divorce FAQs

How is No Fault Divorce different from the old divorce law?

Under the old divorce law, you had to prove that your marriage had broken down by giving one of five reasons, such as adultery, unreasonable behaviour, or a long period of separation. This often meant placing blame on your spouse, even if both of you agreed it was time to separate.

The No Fault Divorce system removes that requirement. Now, you only need to confirm that the marriage has irretrievably broken down. You don’t have to give a reason, provide evidence, or assign blame. The option to contest the divorce has also been removed, which makes the process more straightforward and less stressful.

The language used in the process has changed too, with simpler terms replacing the older legal terminology. These reforms were designed to reduce conflict and help separating couples focus on reaching fair, lasting agreements.

Who can apply for a No Fault Divorce?

You can apply for a No Fault Divorce if you are legally married or in a civil partnership and the relationship has broken down irretrievably. Either person can apply on their own, or both can apply together as joint applicants.

To get divorced in England or Wales, the courts must have legal jurisdiction. This usually means that either you or your spouse lives in England or Wales, or has a strong connection to the country, such as being domiciled here. You don’t need to be a British citizen, and it doesn’t matter where you got married, as long as the court accepts your case.

If you’re unsure about your eligibility, especially if there are international elements involved, it’s important to speak with a solicitor early on.

How long does a No Fault Divorce take?

The No Fault Divorce process takes a minimum of 26 weeks from start to finish. This includes a 20-week reflection period after the application is issued, followed by a further 6 weeks between the Conditional Order and the Final Order.

These timeframes are built into the process to give couples space to consider their decision and make necessary arrangements, such as sorting out finances or child care.

In practice, the full process can take slightly longer depending on how quickly forms are submitted and processed. We’ll guide you through each stage and help avoid unnecessary delays.

What are the benefits of No Fault Divorce?

No Fault Divorce takes away the need to blame your spouse or prove fault, which helps reduce stress, conflict, and unnecessary legal battles. It allows couples to separate with more dignity, making it easier to stay focused on practical matters like children and finances.

The process is also more predictable and streamlined, with fewer opportunities for delay or dispute. For many, this means a faster, calmer separation, and a better chance of moving forward on good terms.

It’s particularly helpful for couples who agree the relationship is over and want a respectful, straightforward way to make it official.

What should I think about before applying for a No Fault Divorce?

Even though the process is more straightforward, divorce is still a major legal and emotional step. Before you apply, it’s important to consider the wider picture, especially your financial situation, living arrangements, and any impact on children.

You should also think about timing. For example, applying before sorting out finances can affect tax, benefits, or pension entitlements. If you’re unsure about when or how to start, getting early legal advice can help you avoid problems later.

We can talk you through your options, help you prepare, and make sure everything is in place to protect your future.

How much does a No Fault Divorce cost?

The court fee for a No Fault Divorce is currently £593. This covers the cost of submitting your application to the court.

If you choose to instruct a solicitor, you’ll also need to budget for legal fees. At NJP, we offer clear, fixed-fee options for divorce, as well as pay-as-you-go services, so you stay in control of your costs at every stage.

We’ll explain all costs upfront, with no hidden fees, and help you choose the right level of support based on your circumstances.

Can my spouse stop or contest a No Fault Divorce?

No. One of the key changes introduced by the No Fault Divorce system is that your spouse cannot contest or block the divorce, unless they are challenging the legal validity of the marriage or whether the courts in England and Wales have jurisdiction. These situations are rare.

This makes the process far less confrontational and gives you more certainty that, once started, the divorce will go ahead.

What if my spouse refuses to cooperate with a joint application?

If you start a No Fault Divorce as a joint application, but your spouse later refuses to continue, you can switch to a sole application. The process won’t be stopped or delayed because the other person has changed their mind or stopped engaging.

We can guide you through this switch and help keep the process on track.

Do I need to wait before applying for a No Fault Divorce?

You must have been married for at least one year before applying for a divorce, that part hasn’t changed. But under the No Fault system, there’s no need to prove separation or wait two or five years, as was previously required for some applications.

If your marriage has broken down irretrievably, you can start the process at any time after the one-year mark.

What happens during the 20-week reflection period?

Once your divorce application is issued by the court, there’s a mandatory 20-week reflection period before you can apply for the Conditional Order. This time is intended to give both parties space to consider their decision and make any necessary arrangements.

It’s also a useful period to resolve financial matters or agree child arrangements, ideally before moving on to the final stages.

Will a No Fault Divorce automatically protect me financially?

No. The divorce itself only ends the legal relationship, it doesn’t deal with how your finances will be split. To protect yourself, you’ll need a separate court order, such as a consent order or a financial remedy order.

Without one, financial claims can remain open, even after the divorce is final. We can help you secure a clean break or a fair settlement that protects your future.

Can I apply for a No Fault Divorce online?

Yes. The government provides an online portal for divorce applications, which can be used by individuals or couples. However, many people still choose to work with a solicitor to avoid common mistakes, prevent delays, and ensure the process runs smoothly, especially where finances or children are involved.

We can handle the entire process on your behalf, keep you informed at every stage, and ensure nothing is missed.
