The Stakes Are High: Make Sure You Protect What’s Rightfully Yours

Divorce can be overwhelming, but securing your financial future is just as important as emotional recovery. Without proper legal guidance, you could risk losing access to vital assets. You deserve a fair settlement that reflects your contributions and secures your future. Not acting now could mean:

Losing out on property or savings you're entitled to.

Facing financial instability in the years to come.

Regretting missed opportunities.

"I recently contacted Njp solicitors and spoke with a lovely lady called Natalie. I needed to try and sort my divorce and mortgage with my ex partner. I'd had the feeling of being "lost and confused" for a while and didn't really know how to start the ball rolling. I was a little nervous, but Natalie made me feel at ease. She answered all my questions in a professional manner but in a way that I could fully understand. She also gave me lots of very useful information, so I felt I could start the ball rolling and realised it wasn't as daunting as I first thought. There was absolutely no pressure from her, just guidance. I would 100% recommend Natalie!!!!"

Post-Divorce Financial Claims FAQs

Can my ex-spouse make a financial claim against my assets after our divorce?

Yes, unless you have a legally binding financial settlement in place (clean break consent order), your ex-spouse may still be able to make a claim against your assets, even years after the divorce. To prevent future claims, you should obtain a Clean Break Order, which legally ends any financial ties between you and your ex. The best time to do this is ideally during the divorce.

What is a Clean Break Order, and why do I need one?

A Clean Break Order is a legal document that confirms both parties have no further financial claims against each other after a divorce. Without it, your ex-spouse could claim a share of your future income, inheritance, or assets. If you want full financial independence, getting a Clean Break Order is essential.

If we agreed on finances informally, can my ex still make a claim?

Yes. Verbal agreements or informal written agreements are not legally binding. Without a court-approved financial settlement, your ex-spouse could apply for a share of your assets, even years after the divorce. The safest option is to get a Consent Order, which legally records your agreement. You can obtain an order via Solicitors, your don’t have to attend court to obtain an Order.

How long after a divorce can my ex-spouse make a financial claim?

There is no time limit for making financial claims after a divorce unless a Clean Break Order has been obtained. This means your ex could try to claim a share of your wealth even decades later. The only exception is if they remarry, in which case they lose the right to claim (they do have other routes they can use though).

Can I claim financial support from my ex-spouse after the divorce?

Yes, if you did not agree to a financial settlement at the time of the divorce, you may be able to make a financial claim, particularly if your circumstances have changed. For example, if you sacrificed your career to raise children, you might still be entitled to spousal maintenance.

What happens if my ex-spouse refuses to follow the financial settlement?

If your ex-spouse does not comply with a court-ordered (whether agreed or via the courts) financial settlement, you can take legal action to enforce it. The court can order wage deductions, asset seizures, or even penalties for non-compliance. Seeking legal advice early can help you understand your rights.

Does a Clean Break Order cover child maintenance?

Yes, it can include child maintenance. However, maintenance is a separate legal obligation and must still be paid according to government guidelines or a private agreement.

What happens if I inherit money after my divorce?

If you do not have a Clean Break Order, your ex-spouse may be able to claim a portion of your inheritance, even after your divorce. To protect your assets, it’s essential to legally finalise financial matters with a financial settlement and consent order.

How can I protect myself from future financial claims after divorce?

The best way to prevent future claims is to get a Clean Break Order or a Consent Order as part of your divorce process. These legally confirm that neither party can make future financial claims, giving you financial security and peace of mind.
